Lawyers representing Minority Leader Alexander Afenyo-Markin state that Ghana Gold Board (GoldBod) CEO Sammy Gyamfi has been legally served with a defamation writ, pushing back against claims that the Minority Leader is dodging court proceedings.
The legal firm Dehyena Chambers issued a statement on Saturday, August 29, confirming that court documents were delivered to Gyamfi’s legal representatives following an explicit request from his lawyers.
The statement responds to earlier action from Gyamfi’s legal counsel, Ayine & Partners. In a letter dated August 26, 2026, Ayine & Partners informed the High Court that they held express authority from Gyamfi to accept all court processes on his behalf at their office in East Legon, Accra.
Dehyena Chambers stated that while the court writ was delivered to Gyamfi’s lawyers as requested, the firm returned the papers to the court registry the next day.
Legal representatives for Afenyo-Markin further noted that a court bailiff tried to deliver the documents directly to Gyamfi at his office on August 27. According to the firm, Gyamfi refused to receive the paperwork and ordered security staff to clear the bailiff from the premises.
Dehyena Chambers rejected claims that Afenyo-Markin is avoiding service, pointing out that the duty to deliver court papers lies with the court registry rather than the person filing the suit.
“It must be emphasized that it is the Defendant who first authorised his lawyers to accept service of the writ which they complied only for the lawyers to return the process after service had been effected on them. Yet when personal service was attempted on the Defendant, he refused same according to the bailiff” the statement said.
Pointing to Order 7, Rule 12(2) of C.I. 47, Afenyo-Markin’s legal team stressed that service is legally complete when an attorney who commits in writing to accept documents receives them. Because of this, they maintain Gyamfi is fully aware of the action and must submit his response.
“We urge those spreading the contrary narrative to desist. The relevant correspondence and the Bailiff’s official record speak for themselves. Whatever be the situation, once his solicitors accepted the writ, Mr. Sammy Gyamfi is fixed with Knowledge of the writ against him and is required by law to file his appearance and defence to the suit before the Court” the statemnet added.
The court action stems from public disputes concerning GoldBod’s operations and financial losses tied to the Bank of Ghana’s Domestic Gold Purchase Programme. Afenyo-Markin filed the defamation suit after Gyamfi allegedly referred to him as an “extortionist” during their public exchanges.
