A 50-year-old man from High Falls, New York, is facing serious legal trouble after allegedly posting threats online targeting former President Donald Trump and tech billionaire Elon Musk.

According to federal court filings, Brian Tate is accused of threatening to assassinate Trump on X (previously Twitter) and inciting violence against Elon Musk.

Tate, who goes by the handle @JamesTate121, is claimed to have published frightening postings with violent language and imagery. One such post included a violent GIF of Trump’s skull exploding, as well as a comment implying that he could do such an act from 300 yards away with a.270 caliber rifle. All of which are included in the document.

According to the FBI document, Tate made several aggressive posts in December 2024. Among them was a comment to a news item claiming Elon Musk was assaulting Social Security. Tate allegedly responded, “Millions of us declare war back,” meaning a demand for violent retaliation.

In a follow-up exchange, after a user commented that Musk “has no idea what will hit him,” Tate allegedly responded, “270 in the back of ear from 300 yards,” referencing both a specific rifle caliber and a method of attack.

Authorities confirmed that Tate has a prior conviction for unlawful marijuana sales, making him a prohibited person under federal weapons regulations. Investigators noted that, while Tate admitted to creating the posts, he maintained they were not meant as actual threats.

According to the affidavit, Tate told federal agents he was ranting about personal difficulties relating to his children, especially while under the influence of alcohol. He also maintained that he did not own a firearm and had no intention of harming anyone.

Despite Tate’s denial of intent, law enforcement officials obtained search warrants for his residence in the Hudson Valley area. The warrants were based on probable cause that he may have committed interstate threats and could be unlawfully in possession of a weapon.

As of Monday afternoon, Tate’s alleged X profile remained live and described him as a “father of 3 wonderful kids… trying to save America from The Trump Cult.” His large following reportedly over 95,000 users, adds gravity to the situation, considering the reach and influence of his controversial statements.

Tate’s case raises concerns over online threats escalating into real-world actions, especially as political tensions continue to run high. Federal authorities are expected to continue their investigation, with possible charges related to threats against a former president and illegal firearm activity still pending.
