The 21-year-old, along with three of his former youth team teammates—Ferran Ruiz, Juan Rodriguez, and Andres Garcia—is under investigation for an incident that allegedly occurred on June 15, 2023, in Gran Canaria.

The girl’s mother reported the incident to Spanish authorities nearly two months later, sparking an ongoing criminal investigation.

According to the mother’s complaint, one of the four men filmed explicit footage of her daughter and then shared it.

While the complainant confirmed the sexual activity was consensual, she insisted the recording was not, and it was this breach of consent that is at the heart of the legal case.

Asencio, who had played for Real Madrid in their recent Champions League match against Manchester City, appealed to the Provincial Court of Las Palmas to have the charges dropped, arguing that the evidence was speculative.

However, the court upheld the charges, ruling that there were “reasonable indications” of criminal activity.

Investigations revealed that one of the suspects testified that Asencio had shown him the video, and mobile records indicated it was shared via WhatsApp.

In addition, conversations between the suspects contained derogatory remarks about the girl involved.

Under Article 197 of Spain’s Criminal Code, anyone found guilty of recording and sharing explicit content involving a minor faces a prison sentence ranging from three-and-a-half to five years.

If Asencio is found guilty of only non-consensual recording, the sentence could be reduced to between two-and-a-half and four years.
