Trump And Family Denied Request To Have $250 Million Lawsuit Dismissed

On Friday, a New York state judge rejected requests by former president Donald Trump, Donald Trump Jr., Eric Trump, and Ivanka Trump to dismiss the $250 million lawsuit brought by the New York attorney general, calling some of the grounds “frivolous.”

When placing a monitor on the Trump Organization last year, Judge Arthur Engoron had already rejected a number of the Trumps’ legal defenses.

He determined on Friday that the Trumps’ repeating of the points was “frivolous” in a written order.

“Reading these arguments was, to quote the baseball sage Lawrence Peter (‘Yogi’) Berra, ‘Déjà vu all over again,’” the judge iterated.

Moreover, Engoron had thought about punishing the Trumps’ attorneys but opted against it.

In light of this, the judge added, “Sophisticated defense counsel should have known better, In its discretion this Court will not impose sanctions, which the Court believes are unnecessary, having made its point.”

The judge also disregarded the Trumps’ claims that some of the alleged fraudulent behavior took place after the legal statute of limitations had expired.

Ivanka Trump, who left the company in 2017 to take a job in the White House, asserted that the charges against her were outdated and that she didn’t fudge any financial documents on her own.

According to the judge, the attorney general’s office has “sufficiently” accused Trump of wrongdoing to withstand a motion to dismiss.

The judge must give the plaintiffs’ accusations more weight in a petition to dismiss.

Letitia James, the attorney general of New York, filed the initial complaint in September, alleging that the Trumps had used false financial statements to achieve advantageous insurance and loan rates as well as tax advantages.

Since then, Donald Trump, who has denied any wrongdoing, has made numerous legal attempts to obstruct James’ probe.

His plea to prevent James’ office from getting documents from the Donald J. Trump Revocable Trust, which he established to hold his businesses after becoming president in 2017, was denied by a federal judge in Florida in December.

Hours after a New York judge rejected a request to transfer James’ complaint to a different division of New York state court, Donald Trump filed the civil action in November.
