A 33-year-old woman from Indiana is facing charges after allegedly attacking a 12-year-old girl during a confrontation over line-cutting at the West Side Nut Club Fall Festival in Evansville. The incident, which took place on Friday evening, escalated into a violent altercation, leaving witnesses and police officers stunned.
Shortly before 8 p.m., police detectives working security at the festival observed a heated argument unfold between Kristin Burnett, the accused, and another woman. The dispute allegedly started when Burnett became upset about someone cutting in front of her in line for an amusement ride, according to a probable cause affidavit. As tensions rose, a 12-year-old girl stepped forward in an attempt to defuse the situation.
The young girl, trying to play peacekeeper, offered to give up her spot in the line, thinking Burnett hadn’t heard her. She approached Burnett in what was described as a “non-threatening manner.” However, instead of resolving the issue peacefully, Burnett allegedly responded with aggression.
According to a detective’s report, Burnett grabbed the 12-year-old by the throat and forcefully pushed her against the gate of the amusement ride. The disturbing scene unfolded quickly, prompting three nearby police officers to rush to the girl’s aid.
A man named Michael A. Flemming Jr. also intervened but reportedly obstructed officers from detaining Burnett. The detective, who witnessed the event, identified himself as law enforcement by flashing his badge.
After both Burnett and Flemming were restrained, the police interviewed the young girl, who revealed that her breathing had been restricted during the attack, and she had temporarily lost sensation in her nose. Four additional witnesses backed the girl’s account, corroborating the details of the altercation.
Kristin Burnett was subsequently arrested and booked at the Vanderburgh County Jail. She faces charges of battery on a person under the age of 14 and disorderly conduct. She has since posted bail and is scheduled to appear in court on Wednesday for her next hearing.

As for Michael A. Flemming Jr., his involvement escalated into a physical altercation with the police. He allegedly kicked one of the officers, causing the officer’s knee to bleed.
Flemming was charged with battery against a public safety official, resisting law enforcement, causing bodily injury, and obstruction of justice. Both individuals now face serious legal consequences for their actions.
The West Side Nut Club Fall Festival has been a cherished event in Evansville for over a century. Since its inception in 1921, the festival has been a staple for the local community, created to enhance the West Side of Evansville and promote goodwill across the city.
