Ohio Crime News: In a tragic case that has shaken the Ohio community, 34-year-old Michael Mayor was sentenced to 15 years to life in prison after pleading guilty to the murder of a 1-year-old girl, Vivian Gardner.
The brutal incident occurred in December 2024, when Mayor was entrusted with the child’s care.
The sentencing, handed down Tuesday, followed Mayor’s June decision to change his plea from not guilty by reason of insanity to guilty. Mayor admitted to slamming the toddler’s head against the floor multiple times after she wouldn’t stop crying.
Authorities revealed disturbing details during the investigation. According to police reports, Mayor confessed that “he ‘shook’ her, and when she cried louder, he began to ‘slam’ her on the floor of the bedroom. He stated this was not done on the blankets and he did this several times until she stopped crying.”
At the time of the incident, Mayor had been left alone with Vivian while his wife, a professional babysitter who had been caring for the child, stepped out to take other children to school.
When she returned, Mayor claimed Vivian was “napping” on the bedroom floor. After checking on her repeatedly, his wife called 911 around 3:00 p.m. when the child still hadn’t woken up.
Vivian was rushed to the hospital, where doctors discovered a fractured skull, a subdural hematoma, and several “complex” injuries described as the result of a “massive impact.” She succumbed to her injuries on December 19, 2024.
Mayor was initially arrested on December 11 and charged with felonious assault and multiple counts of child endangerment.
Those charges were later upgraded to three counts of murder following Vivian’s death. As part of a plea deal, two of the murder charges were dismissed.
During the sentencing, Judge Jeannine Pratt, who presided over the case, expressed her frustration with the legal constraints of Ohio’s justice system. “If I had the discretion, you would be getting a much larger sentence,” she told Mayor.
Though his defense attorney presented a letter of apology from Mayor to the victim’s family, Judge Pratt remained unconvinced. The Dayton Daily News reported that she believed Mayor showed no genuine remorse for his actions.
A spokesperson for Vivian’s family voiced their discontent with the sentencing, expressing fears that Mayor could one day walk free. “We are not satisfied with the possibility that Mayor may be free to rejoin society, to be around children once more,” the statement read.
The family has since committed to advocating for changes in sentencing laws to ensure punishments reflect the gravity of violent crimes, particularly those involving young children.
“We will continue to push for reforms that will ensure that the punishments for violent crimes are commensurate with the impact they have on victims, their families and our communities,” the spokesperson added.
